    On 17 May 2004, Brazil made a submission through the Secretary-General of the United Nations to the Commission on the Limits of the Continental Shelf, pursuant to article 76, paragraph 8, of the United Nations Convention on the Law of the Sea of 10 December 1982. It is noted that the Convention entered into force for Brazil on 16 November 1994.

     The submission contains the information on the proposed outer limits of the continental shelf of Brazil beyond 200 nautical miles from the baselines from which the breadth of the territorial sea is measured.

    In accordance with the Rules of Procedure of the Commission, the Secretary-General is in the process of  notifying the Commission and all States Members of the United Nations, including States Parties to the Convention, of the receipt of the submission, and makes public hereby  the executive summary of the submission, including all charts and coordinates contained in that summary. The consideration of the submission will be included in the provisional agenda of the fourteenth session of the Commission to be held in New York from 30 August to 3 September 2004, which will be followed by two weeks of meetings of a Subcommission.

     Upon completion of the consideration of the submission, the Commission shall make recommendations in accordance with article 76 of the Convention. Article 76, paragraph 8, stipulates that the limits of the shelf established by a coastal State on the basis of the recommendations of the Commission shall be final and binding. The Secretary-General of the United Nations shall then give due publicity to limits thus established.

     On 4 April 2007, the Commission adopted the “Recommendations of the Commission on the Limits of the Continental Shelf in regard to the submission made by Brazil on 17 May 2004 on information on the proposed outer limits of its continental shelf beyond 200 nautical miles.”  Pursuant to article 6, paragraph 3, of annex II to the Convention, the recommendations, were submitted in writing to the coastal State and to the Secretary-General.

     At its twenty-eighth session, the Commission adopted the summary containing excerpts of the recommendations of the Commission in relation to the submission made by Brazil on 17 May 2004.

Reaction of States to the submission made by Brazil to the Commission on the Limits of the Continental Shelf
In response to the note verbale of the Secretary-General, which was circulated in conformity with the Rules of Procedure of the CLCS, a communication was received from the United States of America. The text of this communications was circulated to all Member States of the United Nations and to other States, and was communicated to the members of the Commission at its fourteenth  session (see CLCS/42).

 At its fourteenth and subsequent sessions, the Commission proceeded with the consideration of the submission made by Brazil. For details, see the Statements by the Chairman of the Commission on the Limits of the Continental Shelf on the progress of work in the Commission.

Addendum to the Executive Summary

    On 1 March 2006, Brazil transmitted to the Commission on the Limits of the Continental Shelf, through the Secretary-General, an addendum to the executive summary of the submission made by Brazil. It is recalled that that submission was made, pursuant to article 76, paragraph 8, of the Convention, on 17 May 2004. According to the note accompanying the addendum, the addendum complements information previously provided for examination to the Commission as well as to the Sub-Commission established to examine the Brazilian submission.

    In accordance with the Rules of Procedure of the Commission, as well as the decision of the Commission taken at its sixteenth session (CLCS/48, paragraphs 18 and 19), a communication is being circulated to all Member States of the United Nations and parties to the Convention, in order to make public the addendum to the executive summary of the submission, including all charts and coordinates contained therein.
