Management evaluation: Pursuant to well-settled case law of the Dispute Tribunal and the Appeals Tribunal, requests for administrative review or management evaluation are mandatory first steps in the appeal process. Improper motives: The onus is on the applicant to provide sufficient evidence that the contested decision was tainted by improper motives.

Decision Contested or Judgment Appealed

The Applicant contests two decisions, first the decision to discontinue her post, which was notified to her in writing on 26 August 2010, and second, the decision to terminate her indefinite appointment, which was notified to her on 30 November 2010. However, she only requested management evaluation of the first decision. The Tribunal finds accordingly that the appeal is receivable only insofar as it concerns the first decision. The Tribunal further finds that the Applicant did not produce any evidence that the decision to discontinue her post was arbitrary or based on improper motives.
