The Respondent is in breach of the first order for suspension of action (UNDT/2012/029) – merely providing a different reason for the non-renewal does not obviate the need to abide by the original order.

In February 2012 the Respondent informed the Applicant that his contract would not be renewed, without giving a specific reason, and the Applicant applied to the Tribunal for suspension of action. This was granted on 22 February 2012, pending the outcome of management evaluation. The Respondent now seeks not to renew the Applicant’s contract by virtue of the coup d’état which occurred in the duty station on 22 March 2012.
