With respect to the Cairo post, the application was not receivable because the Applicant did not submit his request for management evaluation on time. However, the Applicant submitted his request for management evaluation of the Fukuoka post decision on time. The Fukuoka decision related to administrative decisions within the Tribunal’s jurisdiction. The administrative decision not to place the Applicant on the roster was made pursuant to rules in force at the time of his engagement by UN-Habitat and was one that directly affected his rights. The Respondent’s decisions not to disclose documendation relating to the decision not to include the Applicant in a roster or information about the membership of the Central review Body were administrative decisions. UNDT had jurisdiction over these issues and they were receivable.
The Applicant challenged the decision not to include him in the roster following his non-selection for two posts (Cairo and Fukuoka) and the Respondent’s refusal to disclose information aubsequently requested by the Applicant about the roster process.
For a claim regarding an administrative decision to be receivable by UNDT, the administrative decision must be one that has direct legal consequences on an individual’s rights and obligations.
