The Tribunal found that the Applicant’s submission did not contain any dates for the impugned acts, nor any succinct statement of facts and reasons to contest such acts. It therefore dismissed the case for lack of substance and abandonment of proceedings.
The Applicant filed a one-page submission through the UNDT eFiling portal, without any supporting evidence such as a request for management evaluation, and he was reminded several times to file an application using the correct form and attaching all relevant documentation. The Applicant failed to comply with the Tribunal’s instructions and instead filed two requests for an extension of time to file an application.
Abandonment of proceedings: An applicant who does not meet the minimal requirements to file an application, despite several reminders, is in fact abandoning the proceedings. His or her submission may be rejected by summary judgment.
