UNAT considered an application for revision of judgment No. 2010-UNAT-084 filed by the estate of Mr Sanwidi. UNAT held that the estate of Mr Sandwidi did not present new evidence but merely expressed disagreement with the judgment. UNAT denied the application for revision.
In judgment No. 2010-UNAT-084, UNAT overturned UNDT’s finding that the disciplinary measure imposed upon Mr Sanwidi was disproportionate to his conduct. UNAT concluded that, by entering into a currency exchange transaction with a vendor of MONUC, Mr Sanwidi failed to meet the standards expected of a staff member involved in procurement, his misconduct was serious, and the disciplinary measure of summary dismissal was not disproportionate. UNAT affirmed the decision to summarily dismiss him.
The review procedure is of a corrective nature and thus is not an opportunity for a party to reargue his or her case.
