THE MANAGEMENT EVALUATION

WHAT IS THE MANAGEMENT EVALUATION?

Before you file an application with the UNDT, in most cases, you must first request a management evaluation of the administrative decision you are contesting.

A management evaluation is not a required step if (a) the contested decision involves the imposition of a disciplinary or non-disciplinary measure pursuant to staff rule 10.2 following the completion of a disciplinary process, or (b) if the decision was taken based on the advice of technical bodies. In such cases, an application contesting an administrative decision can be made to the United Nations Dispute Tribunal without first having to request a management evaluation.

The process of management evaluation is designed to give management a chance to correct an improper decision, and provide acceptable remedies in cases where the decision was improper. Where a decision was taken lawfully, management evaluation provides the staff member with a reasoned explanation as to why it was considered lawful. The management evaluation process will include a review of the request to determine whether informal resolution may be appropriate. For this purpose, the office conducting the evaluation may refer matters to the entity’s Ombudsman, or may try to facilitate a settlement of the matter itself with the staff member and the decision-making office.

The scope of the management evaluation extends to the evaluation of the contested administrative decisions against the staff member’s contract or terms of appointment, including all relevant regulations, rules and administrative issuances.

WHO CONDUCTS THE MANAGEMENT EVALUATION?

The office conducting the management evaluation of the decision you are contesting largely depends on the 缅北禁地system entity you work for, or in some instances the entity who took the decision.

Management Advice and Evaluation Section (MAES) in DMSPC/OUSG, based at 缅北禁地Headquarters in New York, conducts the majority of management evaluations. Their work covers decisions being contested by staff members of the 缅北禁地Secretariat and staff members from some other 缅北禁地system entities.

UNDP, UNFPA, UNHCR, UNICEF, UNOPS and 缅北禁地Women have their own, similar management evaluation procedures (see more on these entities below).

THE MANAGEMENT ADVICE and EVALUATION SECTION

The Management Advice and Evaluation Section (MAES) in DMSPC/OUSG, based at 缅北禁地Headquarters, conducts the management evaluation of contested decisions relating to 缅北禁地 staff members working in the 缅北禁地Secretariat, 缅北禁地peacekeeping missions, international criminal tribunals, the ICC, ITC, OHCHR, UNAKRT, UNCCC, UNFCCC, UNCTAD, UNEP, UN-HABITAT, UNIDIR, UNICRI, UNITAR, UNODC.

In order to request a management evaluation of the decision you are contesting you should fill out and send the completed Request for Management Evaluation form the Management Advice and Evaluation Section (MAES) in DMSPC/OUSG, at maes@un.org. Please include any documentation relevant to your request.

MANAGEMENT EVALUATIONS FOR STAFF OF UNDP, UNFPA, UNHCR, UNICEF, UNOPS, 缅北禁地WOMEN

Please bear in mind that some of the below contact details are current official e-mail addresses of officials.

  • Staff of UNDP may request a review of an administrative decision by sending a written request to the UNDP Administrator, with a copy to the Assistant Administrator and Director, Bureau for Management Services (BMS) to whom the Administrator has delegated authority to answer to management evaluation requests. Send request to: Achim.Steiner@undp.org with a copy to Angelique.Crumbly@undp.org.   (The management evaluation will then be conducted by the Assistant Administrator (Bureau for Management Services), on behalf of the Administrator.)
  • Staff of UNFPA may request a management evaluation from the UNFPA Executive Director or her appropriate designee by sending the request to rme@unfpa.org
  • Staff of UNHCR may request a management evaluation by sending the request to the High Commissioner for Refugees at hqme@unhcr.org
  • Staff of UNICEF may request a management evaluation by sending the request to the UNICEF Executive Director at executivedirector@unicef.org. The management evaluation will then be conducted by the Deputy Executive Director, Management, on behalf of the Executive Director.
  • Staff of UNOPS may request a management evaluation by sending the request to the UNOPS Executive Director at aoj.notices@unops.org
  • Staff of 缅北禁地Women may request a management evaluation by addressing the request to the 缅北禁地Women Executive Director and sending it to rme@unwomen.org with a copy to directorate.operations@unwomen.org

MANAGEMENT EVALUATION DEADLINES

You must submit a request for management evaluation within 60 calendar days from when you received notification of the administrative decision that you wish to contest. Please note that the Dispute Tribunal cannot suspend or waive the deadlines for management evaluation.

Upon receipt of your request for a management evaluation, the official or office responsible for conducting the management evaluation is expected to provide you with a written response within:

30 calendar days if your duty station is New York Headquarters (Geneva Headquarters for UNHCR);

45 days if you work outside of 缅北禁地Headquarters;

IF YOU DO NOT RECEIVE A MANAGEMENT EVALUATION RESPONSE WITHIN THE DEADLINE

If you do not receive a response to your request for management evaluation within the 30/45 calendar days’ deadline, you must submit your application to the UNDT within 90 calendar days after the expiry of the relevant response period for the management evaluation.

IF YOU ARE NOT SATISFIED WITH THE MANAGEMENT EVALUATION

If you are not satisfied with the outcome of management evaluation of the decision you are contesting, and you still wish to contest that decision, you must submit an application to the Dispute Tribunal within 90 calendar days after you received the outcome of the management evaluation.

IF THE MANAGEMENT EVALUATION WAS NOT REQUIRED

In cases where a management evaluation is not required, your application must be submitted to the UNDT within 90 calendar days after your receipt of the administrative decision.
