    The Tribunal found that the instant case is not comparable to AAE 2023-UNAT-1332 as the Applicant only refers to the“harm this case has caused” him and the “sensitive information” referred to in the case without providing further reasons for the Tribunal to deviate from the principles of transparency and accountability.     The Appeals Tribunal found that in its rigid treatment of the evidence in relation to AAY’s conduct, the UNDT failed to have appropriate regard to what had been admitted to by AAY when interviewed by OIOS.     The Tribunal held:

    1. Insofar as Decision A had already been ruled upon by two judgments that were now final, that part of the application was not receivable, being res judicata.

    2. The Applicant’s challenges of Decisions B, C and D which were grounded on her Appendix D claim of 12 November 2020, were not receivable, being time-barred.

    3. The consequential decisions arising from Decisions A - D were all rejected as irreceivable because they could not stand on their own.

    Regarding the decision to not convene a fact-finding panel, the Tribunal recalled its jurisprudence which indicates that a fact-finding investigation may only be undertaken if there are sufficient grounds to believe that a staff member had engaged in unsatisfactory conduct.     Regarding the first contested decision, the Tribunal held that the right to know the contents of the report, although summarised, is implicit in the right of a staff member to complain against third persons (right already acknowledged in Belkhabbaz, UNDT/2021/047 at para. 21) because this right includes the right to know the reasons for which the Administration did not punish the accused person.

    The Tribunal, therefore, concluded that the Applicant had a right to receive the report in full, with reasonable redactions, from the Administration. Therefore, the claim in question was granted.

    The Appeals Tribunal concluded that the UNDT did not err in finding that the Administration had established that AAR had unlawfully disclosed confidential information and had unlawfully failed to disclose a conflict of interest and recuse himself.

    The Appeals Tribunal was also satisfied that the administrative measure imposed on AAR was proportionate to his misconduct, and that the UNDT did not commit any error in awarding moral damages for the harm AAR incurred due to the undue delay in completing the disciplinary process.
